Terms of Service for Tortma

1. Acceptance of Terms

By installing, accessing, or using Tortma (“the Extension”), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not install or use the Extension.

2. Description of Service

Tortma is a browser extension, available for Chrome and Firefox, that helps users organize, manage, and categorize their YouTube videos and playlists through a drag-and-drop interface. Some features are offered free of charge, while others require a paid subscription.

3. User Obligations

When using Tortma, you agree that you will:

  • Comply with YouTube's Terms of Service and Google's Terms of Service.
  • Maintain the security of your Google account and credentials.
  • Use the Extension only for lawful purposes and in compliance with all applicable laws.
  • Not attempt to reverse engineer, decompile, or misuse the Extension or its underlying services.
  • Not use the Extension to infringe upon the rights of others.

4. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use Tortma for personal or internal business purposes, subject to these Terms. All rights not expressly granted are reserved by us.

5. Data Usage and Privacy

Your use of Tortma involves both local processing in your browser and server-side processing as described in our Privacy Policy.

By using the Extension, you acknowledge and agree that:

  • Certain data, such as your Google account email, drop counts, license information, and video-to-playlist mappings, is transmitted to and stored on secure third-party servers including Supabase.
  • Your Google access and refresh tokens are stored only on your device, encrypted with AES-GCM. To keep you signed in, the Extension sends your refresh token over HTTPS to our own token-refresh function, which exchanges it with Google for a new access token and discards it without storing it. Your tokens are never written to our databases, so we cannot revoke them for you; you can revoke Tortma's access to your Google account at https://myaccount.google.com/connections?filters=3,4.
  • AI features may send video metadata (title, channel name, and a short description excerpt) to third-party AI providers — TypeSafe for categorizing a dropped video, and Alibaba Cloud (DashScope / Qwen), with Groq as a fallback, for suggesting names for new playlists. Account details and tokens are never included in those requests.
  • Subscription billing and tier provisioning are handled by Polar.sh.
  • Our website (tortma.com) uses Google Analytics (installed via the Google tag) to collect usage data such as pages viewed, interactions, traffic source, device/browser details, and approximate location — only after you give consent via our cookie banner where required — as described in the Privacy Policy.
  • All data handling is governed by our Privacy Policy, which is incorporated into these Terms by reference.

6. Subscriptions and Payments

Tortma offers the following subscription tiers:

  • Free: 15 drops per day, 200 drops per month.
  • Pro: 60 drops per day, 800 drops per month — $4.99 per month, or $39 per year.
  • Drop Pack: a one-time $2.99 purchase that adds 100 extra drops on top of your tier limits. Refunds are issued by the payment provider; when a refund is issued, the delivered drops are removed from your account balance.
  • Trial gift: new users may receive 14 days of Pro limits free, no card required.

Subscription fees, billing cycles, and cancellation terms are managed through the payment provider you select during checkout. All payments are final unless otherwise required by law or the payment provider's policies.

7. Usage Limits

We enforce daily and monthly drop limits based on your tier to ensure fair use of our services. Daily limits reset each calendar day and monthly limits reset on the first of each calendar month. Attempting to circumvent these limits or abuse the service may result in suspension or termination of your access.

8. Disclaimer

Tortma is provided “as is” and “as available” without warranties of any kind, either express or implied. We are not responsible for any data loss, playlist modifications, account issues, or other problems arising from your use of the Extension. You use Tortma at your own risk.

9. Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising out of your access to or use of Tortma.

10. Termination

You may stop using Tortma at any time by uninstalling the Extension from your browser. We reserve the right to suspend or terminate your access if you violate these Terms or engage in activity that harms our service or other users.

11. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will update the “Last Updated” date and may notify you through the Extension or by email. Continued use of Tortma after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Tortma operates, without regard to its conflict of law provisions.

13. Use of YouTube API Services

Tortma shall not and does not encourage users to enter their YouTube credentials or YouTube account information in the Tortma application. Tortma will not allow a user to enter their YouTube account credentials in the Tortma application. The Tortma application will not allow a user to perform any action that YouTube considers to be a violation of the YouTube Terms of Service and Policies.

The user acknowledges and agrees that such use of the YouTube API Services is subject to the YouTube API Services Terms of Service and Developer Policies.
